Kullanıcı Sözleşmesi

Bu Kullanıcı Sözleşmesi ("Sözleşme"), Koz uygulamasını ("uygulama") ve bu web sitesini kullanımınızı düzenler. Uygulamayı indirerek, uygulama içi satın alma yaparak veya kullanarak bu Sözleşme'yi kabul etmiş sayılırsınız. Kabul etmiyorsanız uygulamayı kullanmayın.

1. Lisans

Ödemeniz karşılığında size, uygulamayı Apple ID'niz veya Google hesabınıza bağlı cihazlarda kişisel amaçlarla kullanmanız için devredilemez ve münhasır olmayan bir kullanım hakkı verilir. Uygulama size satılmaz; yalnızca kullanım hakkı lisanslanır.

2. Satın alma ve ödeme

Uygulama, Apple App Store veya Google Play Store üzerinden uygulama içi satın alma (in-app purchase) yoluyla satın alınır ve geçerli bir satın alma tamamlanmadan çalışmaz. Ödeme bilgileriniz (kart numarası, son kullanma tarihi, CVC vb.) hiçbir zaman bize ulaşmaz veya bizim tarafımızdan işlenmez; tüm ödeme işlemleri ilgili mağazanın kendi standart altyapısı üzerinden, kendi gizlilik ve kullanım şartlarına tabi olarak gerçekleştirilir. Satın alımınızı yeni bir cihaza taşımak için, o cihazda aynı Apple ID veya Google hesabıyla oturum açıp "Satın alımları geri yükle" seçeneğini kullanmanız yeterlidir.

Verilerinizden yalnızca siz sorumlusunuz. Uygulama içine eklediğiniz tüm içerikten (notlar, dosyalar, resimler, ses kayıtları ve diğer veriler) ve bunların doğruluğundan, yasallığından ve yedeklenmesinden tamamen siz sorumlusunuz. Koz bu içeriğe erişemez, bir kopyasını tutmaz ve bunu kurtaramaz.

3. Verilerinizin sorumluluğu

Uygulama tamamen offline çalışır ve içeriğiniz yalnızca cihazınızda saklanır. Bu nedenle:

  • Uygulama içindeki tüm verilerden tamamen ve yalnızca siz sorumlusunuz.
  • Verilerinizin düzenli olarak yedeklenmesi sizin sorumluluğunuzdadır. Cihaz kaybı, arızası, silme, PIN'in unutulması veya işletim sistemi sıfırlaması gibi durumlarda veriler kurtarılamayabilir.
  • Koz, verilerinizin kaybı, zarar görmesi veya erişilemez hale gelmesinden sorumlu tutulamaz.

4. Kabul edilebilir kullanım: yasadışı kullanım yasaktır

Uygulamayı yalnızca yürürlükteki yasalara uygun ve meşru kişisel amaçlarla kullanmayı kabul edersiniz. Aşağıdakiler dahil ancak bunlarla sınırlı olmamak üzere, uygulamayı herhangi bir yasadışı amaçla kullanmak kesinlikle yasaktır:

  • Yürürlükteki herhangi bir yasanın, yönetmeliğin veya üçüncü kişi haklarının ihlali;
  • Yasadışı olan ya da başkalarının fikri mülkiyet, gizlilik veya diğer haklarını ihlal eden içeriklerin saklanması veya işlenmesi;
  • Uygulamanın herhangi bir suç faaliyetini kolaylaştırmak amacıyla kullanılması.

Uygulamayı bu Sözleşme'ye ve yasalara aykırı şekilde kullanmanızdan doğabilecek her türlü hukuki ve cezai sorumluluk münhasıran size aittir. Koz, kullanıcıların uygulamaya eklediği içeriği görüntüleyemediği ve denetlemediği için bu içerikten hiçbir şekilde sorumlu değildir.

5. Fikri mülkiyet

Uygulamanın kendisi, tasarımı, logosu ve ilgili tüm materyaller Koz'a aittir ve telif hakkı ile diğer fikri mülkiyet yasalarınca korunur. Bu Sözleşme kapsamında verilen sınırlı kullanım hakkı dışında hiçbir hak devredilmez.

6. Ödeme ve iade

Fiyatlar, satın alma sırasında ilgili mağaza (App Store veya Google Play) tarafından, hesap ve bölge ayarlarınıza göre gösterilir. Ödeme App Store veya Google Play üzerinden alındığı için iade talepleri de doğrudan bu mağazaların kendi iade süreçleri üzerinden yürütülür; ödeme bilgilerinize erişimimiz olmadığından iadeyi biz işleyemeyiz. 7. Garanti reddi

Uygulama "olduğu gibi" ve "mevcut haliyle" sunulur. Yasaların izin verdiği azami ölçüde, açık veya zımni hiçbir garanti verilmez. Uygulamanın kesintisiz veya hatasız çalışacağını garanti etmeyiz.

8. Sorumluluğun sınırlandırılması

Yasaların izin verdiği azami ölçüde Koz; veri kaybı dahil olmak üzere uygulamanın kullanımından veya kullanılamamasından kaynaklanan dolaylı, arızi veya sonuç niteliğindeki zararlardan sorumlu tutulamaz.

9. Sözleşmedeki değişiklikler

Bu Sözleşme'yi zaman zaman güncelleyebiliriz. Güncel sürüm bu sayfada yayımlanır ve uygulamayı kullanmaya devam etmeniz, güncellenmiş koşulları kabul ettiğiniz anlamına gelir.

These Terms of Service ("Terms") govern your use of the Koz app (the "app") and this website. By downloading the app, making an in-app purchase or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. License

In exchange for your payment, you are granted a non-transferable, non-exclusive right to use the app for personal purposes on devices signed into your Apple ID or Google account. The app is not sold to you; only the right to use it is licensed.

2. Purchase and payment

The app is purchased through an in-app purchase via the Apple App Store or Google Play Store, and will not run without a valid purchase. Your payment information (card number, expiry date, CVC, etc.) never reaches us and is never processed by us; all payment is handled through the relevant store's own standard infrastructure, under its own privacy and usage terms. To move your purchase to a new device, simply sign in with the same Apple ID or Google account on that device and use "Restore Purchases".

You alone are responsible for your data. You are solely responsible for all content you add to the app (notes, files, images, audio recordings and other data), including its accuracy, legality and backup. Koz cannot access, keep a copy of, or recover this content.

3. Responsibility for your data

The app runs fully offline and your content is stored only on your device. Therefore:

  • You are fully and solely responsible for all data within the app.
  • You are responsible for regularly backing up your data. In the event of device loss, failure, deletion, a forgotten PIN or an operating-system reset, data may not be recoverable.
  • Koz cannot be held liable for the loss of, damage to, or inaccessibility of your data.

4. Acceptable use: unlawful use is prohibited

You agree to use the app only for lawful, legitimate personal purposes in accordance with applicable law. Using the app for any unlawful purpose is strictly prohibited, including but not limited to:

  • violating any applicable law, regulation or third-party rights;
  • storing or processing content that is unlawful or that infringes the intellectual property, privacy or other rights of others;
  • using the app to facilitate any criminal activity.

You are exclusively liable, both civilly and criminally, for any use of the app that violates these Terms or the law. Because Koz cannot view or moderate the content users add to the app, Koz is in no way responsible for that content.

5. Intellectual property

The app itself, its design, logo and all related materials belong to Koz and are protected by copyright and other intellectual-property laws. No rights are transferred other than the limited right of use granted under these Terms.

6. Payment and refunds

Prices are shown by the relevant store (App Store or Google Play) at the time of purchase, based on your account and region settings. Because payment is taken through the App Store or Google Play, refund requests are also handled directly through those stores' own refund processes; since we never have access to your payment information, we cannot process refunds ourselves. See our Support page for details.

7. Disclaimer of warranties

The app is provided "as is" and "as available". To the maximum extent permitted by law, no warranties of any kind, express or implied, are given. We do not warrant that the app will operate uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Koz shall not be liable for any indirect, incidental or consequential damages, including loss of data, arising from your use of or inability to use the app.

9. Changes to these Terms

We may update these Terms from time to time. The current version is posted on this page, and your continued use of the app means you accept the updated Terms.
